Terms and conditions

The “Terms and Conditions” regulate the service provider-user contract. This document is sometimes known as “Terms of Service” (ToS), “Terms of Use”, EULA, “General Conditions” or “Legal Notes” online.

Terms of Use

These terms bind Users (“User(s), you, your, yourself”) and DIY Schools Private Limited and/or its subsidiaries and affiliates (“DIY, we, us, our”). The website, mobile app, and call centers (collectively referred to as the “DIY Platform”) allow Users to contact with us regarding the DIY Platform’s offerings (“Services”).

Before using DIY products or services, please read these terms. If you disagree with these Terms of Use, you may not use the DIY Platform or Services. These terms and conditions must be read with other DIY Platform and Services terms and conditions.

DIY may change these Terms of Use at any moment. You must regularly review the Terms of Use, and your continuing use of the DIY Platform and Services constitutes acceptance of these terms and any changes.

1. Service Scope

DIY Platform connects Users with third parties (“Channel Partners”) or DIY to use their websites and apps to assist Users use the Services. DIY Platform provides Users with DIY Products, including:

  • DIY School
  • DIY College
  • DIY Coaching
  • DIY-Tuition

2. Use eligibility

You must be 18 or older to enter, perform, and agree to these terms. Users under 18 must be supervised by their parents or legal guardians to use the DIY Platform under their registered account. If DIY detects User is under 18, DIY may cancel User’s access and refuse to supply the DIY Platform.

3. DIY Platform: Account Registration and Use

The DIY Platform makes the Services available to you once you provide the required User information and create an account (“Account”) with DIY ID and password or another log-in ID and password (collectively, the “Account Information”).

Users must create an Account on the DIY Platform to use its Services. You must keep Account Information secret and be accountable for any Account actions. You agree to (a) immediately alert DIY of any unauthorized use of its Account Information or other security breach and (b) log out of the account at the end of each session. DIY is not liable for any loss or damage caused by your failure to comply with this condition. Because you failed to safeguard and confidentially store your Account Information, DIY or any other customer or visitor to the DIY Platform may suffer losses due to authorized or unauthorized usage of your account.

DIY provides restricted Platform access to unregistered users. You must enter complete, accurate, and up-to-date Account Information in the DIY Platform registration form. You cannot utilize another user’s account information.

4. Duration and End

You can cancel your DIY Platform membership at any time. DIY reserves the right to unilaterally terminate your usage of the DIY Platform without warning or liability for breaching these terms.

Customer-specific terms:

Customers using the DIY Platform to purchase Services and DIY Products are subject to the following terms and conditions:

A. Service booking

Booking Services from this DIY Platform may demand sensitive and confidential information. To prevent unauthorized access to your confidential information like name, address, etc., you must not use/access this site from unsecure computers, communication links, mobile phones, Internet-Cafe(s), Cyber-Cafe(s), and other commercially available internet-enabled computers or computer services. The User accepts, acknowledges, and confirms that before placing any order on the DIY Platform, the User shall carefully verify the Service description and price, and by placing an order, you agree to be bound by these terms, including the Service description.

  1. The User has no legal or other limitations that prevent them from:

(i) Signing a legal contract and (ii) paying DIY for User-ordered Services.

  1. DIY has the right to cancel all pending and future orders if it detects suspicious behavior from User’s account without liability.
  2. Use your own credit card that User has complete right and power to use to pay DIY. DIY will not be liable for credit card fraud. The User must ‘prove otherwise’ if they use a card fraudulently.
  3. User must always follow the payment procedure and terms when using the DIY Platform.
  4. You agree to DIY’s Platform’s representation of the accommodation’s description, appearance, and price by using the Services.

Payment/Usage Fee

You agree and understand that you must pay the DIY Platform’s usage fee for the relevant Services via the payment option given on the DIY Platform to confirm User’s reservation. DIY will deduct the usage cost from the User’s payment mode after entry. The User acknowledges that the payment procedure may involve further verification or information from the User and agrees to supply complete, correct, and proper information.

 

DIY accepts User payments through third parties. DIY is not liable for payment errors, payment delays, or reservation cancellations. DIY works carefully with third-party payment providers but does not control their systems, methods, technology, or work flows therefore cannot be held responsible for their errors.

C. No Warranty

You agree that DIY is not a school/college/coaching/tuition owner and has no control over the behavior or behavior of property management or the quality, fitness, or suitability of third-party services by utilizing the DIY Platform. DIY disclaims any liability here. Please safeguard their personal belongings. DIY and its personnel are liable for any loss, theft, or damage to students’ personal items.

7. Prohibited Content

User warrants to DIY that User shall not use this DIY Platform for any unlawful, unauthorized, or inconsistent purpose, and User agrees that this licence to use DIY Platform will terminate immediately upon User’s violation of this warranty. DIY may block/terminate User’s access to this DIY Platform and its content without notice at its sole discretion. User accepts, acknowledges, affirms, and undertakes that registration data, information/data submitted or published onto DIY Platform:

Must be truthful, accurate, and full; or b. shall not be fraudulent or utilize stolen or counterfeit Credit Cards; or c. shall not violate any other party’s intellectual property, trade secret, proprietary, publicity, or privacy rights; or d. shall not defame, libel, threaten, or harass; or e. shall not contain viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs, or other computer programming routines or executable files that may damage, harm, intercept, or steal any system, data, or personal information; or f. shall not obligate DIY or force DIY to lose its ISPs or other service providers/suppliers. If the User violates the preceding or DIY has reasonable reasons to think that the User has violated it, DIY may indefinitely deny or terminate User’s access to the DIY Platform and refuse to honor the User’s request.

Users cannot do the following:

  • Systematically obtain data or other content from the DIY Platform to create a collection, compilation, database, or directory without our explicit consent.
  • Unauthorized use of the DIY Platform includes gathering usernames and email addresses for unsolicited email or creating user accounts automatically or fraudulently.
  • .c. Circumvent, deactivate, or otherwise interfere with DIY Platform security mechanisms, including features that prevent or restrict Content use or copying or enforce limitations on DIY Platform usage and Content.
  • Framing or linking the DIY Platform without permission.
  • In order to steal passwords or other sensitive account information, deceive us and other users.
  • Misuse our support services or report abuse or wrongdoing falsely.

 

  • Use scripts to send comments or messages, data mining, robots, or other automated data gathering and extraction methods.
  • Disrupt, burden, or interfere with the DIY Platform or its networks or services.
  • Try to mimic someone or use their username.
  • Sell or transfer your profile.
  • Use DIY Platform information to harass, abuse, or injure someone.
  • Use the DIY Platform to compete with us or for any commercial purpose.
  • Decipher, decompile, disassemble, or reverse engineer any DIY Platform software.
  • Bypass any DIY Platform security mechanisms to gain access to the platform or any part of it.

Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other material, including excessive capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the DIY Platform or modifies, impairs, disrupts, alters, or interferes with its use, features, functions, operation, or maintenance.

Upload or transmit passive or active information collection or transmission material.

  1. Use, launch, develop, or distribute any automated system, including any spider, robot, cheat utility, scraper, or offline reader that accesses the DIY Platform, or any unauthorized script or other software, except as may result from standard search engine or Internet browser usage.

Communications

When you use the DIY Platform, you agree and understand that you are communicating with DIY via electronic records and consent to receiving DIY communications periodically and as needed. DIY may contact you via email or other means. You acknowledge that DIY is not liable for unauthorized access to or alteration of your communications or data, whether sent or received. DIY will try to keep your personally identifiable information private, but internet communications cannot be guaranteed. DIY shall not be accountable for disclosure of your information due to transmission mistakes or unauthorized third parties by utilizing this DIY Platform. Without limitation, you agree that DIY is not liable for ‘phishing attacks’ on you. DIY Platform lets you accept or reject cookies. The User must adjust his browser to notify him of cookie acceptance or rejection.
